Acceptance of Terms
These Terms and Conditions (“Terms”) form a legally binding agreement between you (“you”, “your”, the “User”, the “Host”, or the “Renter”) and The Tradie List Pty Ltd (“we”, “us”, “our”, or the “Company”), which governs your use of this website and our services.
By clicking “I Accept”, creating an account, or using our platform, you enter into a legally binding agreement with The Tradie List and agree to comply with these Terms and our Privacy Policy.
You warrant that you are at least 18 years of age and have full legal capacity to enter into this agreement. If you do not accept these Terms in full, you must not use or access the website.
We reserve the right to update or amend these Terms from time to time. Any changes take effect immediately upon being published on the website. Your continued use of the platform constitutes your acceptance of the revised Terms.
2. Defined Terms
Host – a registered user offering a space, tool, or equipment for rent through the website.
Renter – a registered user booking or renting a space, tool, or equipment through the website.
Space – the physical area offered by a Host for use by a Renter, including but not limited to storage, parking, workshops, garages, or offices.
Tool/Equipment – any machinery, tool, or device listed by a Host for short-term hire.
Listing – an advertisement created by a Host offering a Space or Tool for rent on the website.
Contract – a binding agreement between Host and Renter facilitated by The Tradie List through a confirmed booking.
Rental Fee – the total amount payable by a Renter for a booking, inclusive of The Tradie List Service Fee where applicable.
Service Fee – the commission charged by The Tradie List for facilitating transactions on the platform.
Bond – an optional refundable deposit set by the Host to cover loss, damage, or late returns.
Prohibited Items – items or materials that cannot be rented, stored, or handled through our platform (e.g., hazardous chemicals, weapons, live animals, stolen goods, or illegal materials).
3. Purpose of the Site
The Tradie List provides a digital marketplace where Hosts and Renters can connect to list, book, and rent spaces and tools. We supply the platform and associated technology that enables Users to create listings, request bookings, and complete transactions.
The Tradie List is not a rental agent, broker, or property manager, and we are not a party to any contract between Hosts and Renters. We act solely as an intermediary to facilitate bookings and process payments.
4. General Conditions
We reserve the right to suspend or terminate your account, remove a Listing, or limit access to the website for any reason, including violations of these Terms or inappropriate content.
The Tradie List may verify identity or business information of Users to ensure trust and safety on the platform.
Users agree that The Tradie List is not responsible for the accuracy, condition, or suitability of any Listing or rental arrangement. All transactions occur at the Users’ own risk.
The laws of the State of New South Wales, Australia govern these Terms, and all parties submit to the exclusive jurisdiction of its courts.
5. User Registration and Accounts
- To access our services, you must register an account by providing accurate details such as name, email, and password.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- Users may be required to verify their identity or business details before posting Listings or making bookings.
- You agree to keep your information current and notify us of any changes within 7 days.
- Accounts may not be transferred or shared without written consent from The Tradie List.
6. Host Responsibilities
- To create a Listing, the Host must provide accurate and complete information about the space or tool offered, including its condition, location, dimensions, features, access conditions, and pricing.
- Hosts must ensure that any listed space, tool, or equipment is safe, functional, and complies with all applicable laws and safety standards.
- The Host is responsible for ensuring that they have the legal right to rent out the space, tool, or equipment listed and that doing so does not breach any third-party agreements (e.g. lease, insurance, or property rules).
- The Host must promptly update or remove Listings if the space or tool becomes unavailable.
- The Host agrees to not request or accept payments outside The Tradie List platform. Doing so may result in account suspension or permanent removal.
- The Host is responsible for any damage caused to the Renter or their property due to the Host’s negligence or misrepresentation.
- Hosts must maintain appropriate insurance coverage for the listed property, tools, or equipment and comply with all Australian consumer and safety laws.
7. Renter Responsibilities
- By entering into a Contract, the Renter agrees to use the rented space or tool responsibly and in accordance with its intended purpose.
- Renters must inspect and confirm the condition of the space or tool before use and report any issues to the Host immediately.
- Renters must not sublet, lend, or transfer the use of the rented space or tool to any third party without written consent from the Host.
- The Renter must make full payment through the platform using the available payment system before access or possession is granted.
- Renters are responsible for any damage, loss, or misuse caused to the space, tool, or equipment during the rental period.
- At the end of the rental term, Renters must return the tool or vacate the space in the same clean and functional condition in which it was received.
- The Tradie List reserves the right to suspend or remove Renters who fail to comply with payment obligations, safety requirements, or fair use policies.
8. Payments and Fees
All payments between Hosts and Renters are processed securely through The Tradie List’s payment gateway.
The total amount payable by the Renter (“Rental Fee”) includes:
The Host’s price (set by the Host), and
The Service Fee, a small commission retained by The Tradie List.
The Tradie List deducts its Service Fee automatically before releasing the remainder to the Host.
Payments are typically released to the Host within five (5) business days after the Renter’s booking begins or the rental has been confirmed.
Renters authorise recurring billing for ongoing rentals (e.g. monthly or weekly agreements) where applicable.
The Tradie List uses secure third-party payment processors. By using the platform, you also agree to the terms of those payment services.
The Tradie List is not liable for delays in payments caused by banks, third-party providers, or incorrect account information.
9. Cancellations and Refunds
- Bookings can be cancelled without penalty within 24 hours of confirmation (“Cooling-Off Period”).
- If a cancellation occurs after 24 hours, the following applies:
- Renters: Must provide at least 7 days’ notice before the start of the rental period for a full refund (minus transaction fees).
- Hosts: Must provide at least 7 days’ notice before the rental begins to avoid penalties.
- Cancellations within less than 7 days may result in partial refunds or forfeiture of the first week’s fee, depending on circumstances.
- The Tradie List reserves the right to mediate disputes and issue refunds or credits at its sole discretion.
- Repeated cancellations or misuse of the booking system may result in account suspension.
10. Prohibited Use and Items

11. Insurance and Liability
- Host insurance: Each Host is responsible for maintaining any insurance required for their listed property, tools, or equipment. The Tradie List does not provide insurance coverage for Hosts or Renters.
- Renter responsibility: Renters use all spaces and tools at their own risk and are liable for any loss or damage they cause during the rental period.
- Platform limitation: The Tradie List operates only as a digital facilitator and is not a party to any agreement between Users. We are not liable for accidents, injuries, property damage, or loss arising from a rental transaction.
- No warranty: All Listings and Services are provided “as is.” We make no representations about the accuracy or fitness of any Listing or the suitability of any User.
- Indemnity: You agree to indemnify and hold harmless The Tradie List, its officers, employees, and contractors from any claims, losses, damages, or expenses arising out of your use of the platform, your Listings, or your conduct toward other Users.
12. Taxes and Reporting
Each User is responsible for understanding and fulfilling their own tax obligations under Australian law.
Hosts: Income earned from renting spaces or tools through The Tradie List may be considered taxable income by the Australian Taxation Office (ATO). Hosts should consult a qualified accountant regarding GST registration, income reporting, and deductions.
Renters: Fees paid for rentals are inclusive of any applicable taxes unless otherwise stated. The Tradie List does not collect GST on behalf of Hosts.
Platform compliance: The Tradie List may be required to report certain user and transaction data to the ATO under the Sharing Economy Reporting Regime (SERR). By using the platform, you authorise us to share this data to meet our legal obligations.
The Tradie List does not provide tax advice and is not responsible for your individual tax reporting or compliance.
13. Privacy and Confidentiality
The Tradie List collects and uses personal information in accordance with our Privacy Policy
(which forms part of these Terms).
We collect information such as your name, contact details, and transaction records to operate and improve our services and to facilitate secure payments and communications between Users.
Your personal data will not be sold or shared with unauthorised third parties except as required by law or to fulfil our services (e.g. payment processors or identity-verification partners).
Users must keep confidential any information about other Users obtained through the platform (e.g. contact details or property addresses) and use it only for lawful rental-related purposes.
You acknowledge that no internet service is completely secure and agree that The Tradie List is not liable for unauthorised access to your account or data beyond our reasonable control.
