Tradie Terms

By using The Tradie List, you agree to our Terms & Conditions that ensure transparency, trust, and a safe experience for both tradies and homeowners.

1. Introduction

These Tradie Terms of Use (“Terms”) govern your access to and use of The Tradie List platform (“we”, “us”, “our”, or “the Platform”). By creating an account, listing your services, or otherwise using the Platform, you (“Tradie”, “you”, or “your”) agree to comply with these Terms. The Tradie List is an online marketplace that connects homeowners and businesses (“Customers”) with verified trade professionals (“Tradies”) across Australia.
These Terms form a binding agreement between you and The Tradie List. If you do not agree to these Terms, you must not register for or use our services. Your continued use of the Platform signifies your acceptance of any updates or modifications to these Terms. You should also review our Terms of Service and Privacy Policy for further details on how we manage your data and the rules governing all users of our site.

2. Eligibility and Registration

To register as a Tradie on The Tradie List, you must be at least 18 years old and legally authorised to work as a service provider within Australia. You are required to hold a valid Australian Business Number (ABN) and any relevant trade or occupational licences applicable to the services you intend to offer. During registration, you must provide accurate, complete, and up-to-date information, including your name, business details, contact information, and proof of licensing or insurance.
We reserve the right to review, approve, reject, or suspend any Tradie account at our sole discretion. False or misleading information may result in immediate account termination. You are responsible for maintaining the confidentiality of your login credentials and for all activities occurring under your account. If you suspect unauthorised access, you must notify us promptly via Contact Support.

3. Tradie Responsibilities

As a registered Tradie, you agree to maintain professionalism and integrity in all interactions with Customers. You are responsible for ensuring that your listings, quotes, and communications accurately represent your services and pricing. You must respond to customer enquiries promptly and perform work to a standard consistent with applicable Australian trade, safety, and consumer-protection laws.
Tradies are required to maintain valid licences, insurance, and certifications at all times. You must not use the Platform to mislead, defraud, or harm Customers. Additionally, you must comply with our code of conduct, treat Customers respectfully, and avoid spam, solicitation, or any unlawful activity. The Tradie List reserves the right to monitor user activity and take action if we believe a Tradie’s behaviour negatively impacts our community or reputation.

4. Service Listings and Job Requests

Tradies can create and manage their service listings through their dashboard. All service descriptions, prices, and images must be truthful and reflect the work you can reasonably perform. Duplicate, misleading, or incomplete listings may be removed. When a Customer submits a job request through the Job Submission Page, you may respond with a quote, ask for clarification, or decline the request.
By using the Platform, you acknowledge that The Tradie List acts only as a facilitator connecting you with potential Customers; we are not a party to any contract between you and the Customer. You are solely responsible for the performance, safety, and completion of your services. You also agree that all content you upload — including photos, text, and logos — may be used by The Tradie List for promotional or marketing purposes in accordance with our Privacy Policy.

5. Payments and Fees

The Tradie List may offer both free and paid plans for tradie listings, leads, and promotional placements. Details of applicable fees, subscriptions, or commissions will be outlined on the Platform or communicated directly to you before purchase. All fees are payable in Australian dollars (AUD) and may include GST as required by law.
You agree to pay any applicable charges on time and understand that failure to do so may result in suspension or removal of your account. Refunds will be handled according to our internal refund policy and are not guaranteed except where required under Australian Consumer Law. Each Tradie is responsible for managing their own taxation obligations, including income tax and GST, arising from jobs completed via the Platform.

6. Verification and Compliance

To maintain the integrity and safety of The Tradie List community, all tradies must provide accurate business details and valid documentation during registration or as requested. This includes, but is not limited to, proof of ABN, trade licences, insurance, and any other certifications relevant to your trade.
We may use third-party verification partners to confirm your credentials. By submitting your details, you authorise The Tradie List to verify and store your information in accordance with our Privacy Policy. You are solely responsible for ensuring that your credentials remain valid and current. Failure to maintain compliance with these requirements may result in suspension or termination of your account.
If we discover or reasonably suspect that false or fraudulent documents have been provided, we reserve the right to remove your profile immediately and, if necessary, report such activities to relevant authorities.

7. Reviews and Ratings

The Tradie List allows customers to rate and review their experience after a job is completed. Reviews help maintain transparency and build trust between tradies and customers. You agree not to manipulate or fabricate reviews in any way, including posting self-reviews or encouraging false feedback.
You may respond publicly to customer reviews through your dashboard, provided that your response remains professional and free from offensive or defamatory language. The Tradie List reserves the right to moderate, remove, or edit reviews or responses that violate our community standards or applicable laws.
Repeated attempts to manipulate ratings or post misleading content may result in account restrictions or removal. Reviews are the property of The Tradie List and form part of our platform’s reputation system.

8. Prohibited Conduct

To maintain a fair and trustworthy platform, all tradies must comply with our code of conduct. You must not:

  • Engage in fraudulent, abusive, or deceptive behaviour;

  • Misrepresent your services, pricing, or qualifications;

  • Circumvent the platform by directing customers to pay outside The Tradie List;

  • Post false or misleading information in listings or communications;

  • Harass, threaten, or discriminate against customers or other tradies;

  • Share private customer data without explicit consent; or

  • Use the Platform for any illegal or unauthorised purposes.

We reserve the right to investigate any activity that violates these Terms and take appropriate action, which may include account suspension, removal of content, or legal proceedings. Any misuse of the Platform that undermines customer trust or platform integrity will result in immediate termination of access.

9. Intellectual Property

All content, trademarks, graphics, and functionality on The Tradie List are owned or licensed by us. You are granted a limited, non-exclusive, and revocable licence to use the Platform for the sole purpose of offering your services.
Tradies retain ownership of any content they upload (such as business logos, service photos, and descriptions), but grant The Tradie List a royalty-free, worldwide licence to display, reproduce, and promote such content on our website, marketing materials, and social media.
You may not copy, modify, or reproduce any part of The Tradie List’s design, code, or branding without written permission. We reserve the right to remove any content that infringes intellectual property laws or another party’s rights.

10. Suspension and Termination

The Tradie List reserves the right to suspend, restrict, or permanently terminate a Tradie account at our sole discretion if we believe there has been a breach of these Terms or any unlawful activity.
Grounds for termination may include non-payment of fees, providing false information, poor service quality, excessive customer complaints, or behaviour that harms the Platform’s reputation. Before permanent termination, we may issue warnings or temporary suspensions where appropriate.
Upon termination, all associated data, listings, and messages may be deleted, and access to your dashboard will be revoked. You remain responsible for any outstanding payments or obligations incurred before termination.
You may request account reactivation or appeal a decision by contacting our support team via Contact Us.

11. Liability and Indemnity

The Tradie List acts solely as an online platform that connects Customers and Tradies. We do not employ, manage, or supervise any Tradie, nor do we guarantee the quality, safety, or legality of the services offered. All agreements and transactions are made directly between you and the Customer.
You acknowledge that The Tradie List bears no responsibility for the completion of any job, the accuracy of information provided by Customers, or for any damages, losses, or disputes arising from your use of the Platform.
By using the Platform, you agree to indemnify and hold harmless The Tradie List, its affiliates, employees, and agents from any claims, liabilities, losses, or expenses — including legal fees — resulting from your services, conduct, or breach of these Terms.

12. Privacy and Data Protection

Your privacy and the protection of customer data are important to us. The Tradie List collects and processes your personal and business information in accordance with the Privacy Policy. By using the Platform, you consent to our collection and use of your data for verification, communication, and service facilitation purposes.
You are responsible for maintaining the privacy of any customer information obtained through the Platform. You must not share, sell, or misuse personal details of customers under any circumstances. Any breach of data privacy laws — including the Australian Privacy Act 1988 (Cth) — may result in immediate account termination and potential legal action.

13. Dispute Resolution

The Tradie List encourages all parties to resolve issues directly through communication. If a dispute arises between you and a Customer, we recommend that both parties attempt to negotiate a fair resolution in good faith.
If the issue cannot be resolved independently, you may contact our support team via the Contact Page for limited assistance or mediation guidance. While The Tradie List may help facilitate communication, we are not an arbitrator and are not responsible for enforcing or resolving disputes.
Should a legal dispute occur, the parties agree that any claim or proceeding must be brought under Australian law, following the jurisdiction outlined in Section 15.

14. Changes to These Terms

The Tradie List reserves the right to amend or update these Tradie Terms at any time. Any updates will take effect once published on the Platform, and notice may be provided through your dashboard or email.
You are responsible for reviewing these Terms periodically to stay informed of any changes. Continued use of the Platform after such changes constitutes your acceptance of the revised Terms. If you do not agree with the updated conditions, you must stop using the Platform and request account deactivation.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia. You agree to submit to the exclusive jurisdiction of the courts located in New South Wales for any dispute or claim arising out of or in connection with your use of The Tradie List.
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.
