Terms of Service

The rules that govern your use of Tradielist — Australia’s marketplace for connecting homeowners with trusted trade professionals.

These Terms of Service (“Terms”) form a binding agreement between you and Tradielist (“we”, “us”, “our”) governing access to and use of our website, apps, and related services (the “Platform”). By registering or using the Platform, you agree to these Terms and our Privacy Policy.

Tradielist is a technology marketplace. Unless we expressly say otherwise, we do not employ tradies, we do not perform trade work ourselves, and we are not a party to the service contract between a homeowner and a tradie.

1. Eligibility

  • You must be at least 18 years old and capable of entering a binding contract under Australian law.
  • Tradies must hold any licences, registrations, and insurances required for the work they offer in the relevant Australian state or territory.
  • You agree to provide accurate, current information and keep your account details up to date.

2. Accounts and security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at support@tradielist.com.au if you suspect unauthorised access. We may suspend or terminate accounts that appear compromised, abusive, or in breach of these Terms.

3. Marketplace role

The Platform helps homeowners discover, message, and book independent tradies. Job details, quotes, scope of works, pricing, timelines, and workmanship standards are agreed between the homeowner and the tradie. You should confirm licences, insurance, and job specifics directly before work starts.

4. Homeowner obligations

  • Provide accurate job descriptions, access instructions, and site conditions that may affect the work.
  • Ensure you have authority to request work at the property.
  • Treat tradies with respect and pay amounts you have agreed, subject to any legitimate dispute process.
  • Leave fair, honest reviews based on actual experience.

5. Tradie obligations

  • Only offer services you are qualified and legally permitted to perform.
  • Maintain required licences, public liability insurance, and any other cover mandated for your trade.
  • Respond to enquiries in good faith, honour quoted scopes and timeframes where reasonably practicable, and communicate delays promptly.
  • Comply with work health and safety laws and leave sites reasonably clean and secure.
  • Do not misuse homeowner data obtained through the Platform for unrelated marketing or unlawful purposes.

6. Fees, subscriptions, and payments

Some Platform features (for example, featured listings or tradie subscriptions) may attract fees. Pricing and billing terms will be shown at the point of purchase. Third-party payment processors may handle card transactions; their terms also apply. Fees already paid are generally non-refundable except where required by the Australian Consumer Law or we expressly agree otherwise.

7. Content and intellectual property

You retain ownership of content you upload (photos, bios, messages) and grant Tradielist a worldwide, non-exclusive licence to host, display, and use that content for operating and promoting the Platform. You must not upload content that infringes others’ rights, is misleading, unlawful, or harmful. The Tradielist name, logos, and Platform software remain our property.

8. Prohibited conduct

You must not:

  • Scrape, reverse engineer, or disrupt the Platform.
  • Create fake accounts, fake reviews, or manipulate rankings.
  • Harass, threaten, discriminate against, or defraud other users.
  • Use the Platform to solicit work in a way that intentionally circumvents safety, verification, or fee mechanisms where those apply.
  • Post illegal content or promote unsafe or unlicensed work.

9. Disclaimers

To the maximum extent permitted by law, the Platform is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted access, that a particular tradie will be available, or that any job will achieve a specific outcome. We do not warrant the quality, legality, or safety of work performed by independent tradies — that remains between you and the tradie — subject always to non-excludable rights under the Australian Consumer Law.

10. Limitation of liability

Nothing in these Terms excludes liability that cannot be excluded under Australian law (including the Australian Consumer Law). Subject to that:

  • We are not liable for disputes, property damage, personal injury, or losses arising from work performed (or not performed) by tradies.
  • Our aggregate liability arising from your use of the Platform is limited to the fees you paid us in the 12 months before the claim, or AUD $100 if you paid no fees.
  • We are not liable for indirect, consequential, or lost-profit damages to the extent permitted by law.

11. Indemnity

You agree to indemnify Tradielist against claims, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, your content, or your interactions with other users, except to the extent caused by our negligence or wilful misconduct.

12. Suspension and termination

You may close your account at any time, subject to completing outstanding obligations. We may suspend or terminate access where we reasonably believe you have breached these Terms, created safety risk, or engaged in fraud. Provisions that by nature should survive (liability, indemnity, IP) continue after termination.

13. Changes

We may update these Terms by posting a revised version on this page. Material changes will be reflected in the “Last updated” date. Continued use after changes take effect constitutes acceptance, except where Australian law requires additional notice or consent.

14. Governing law

These Terms are governed by the laws of Australia and the state or territory in which we principally operate. Courts of that jurisdiction have non-exclusive jurisdiction, without prejudice to your rights under the Australian Consumer Law.
